Liability Waiver

Parent Waiver and Medical Release

• As parent/guardian, you individually and on behalf of your child, release and agree to hold Artlab Maui harmless from any and all liability and hereby assume all risk and responsibility and waive any claim or cause of action of any nature whatsoever arising on behalf of your child while at Artlabmaui or otherwise in the care of its staff. You further agree to indemnify and hold harmless Artlab Maui, its agents, employees or contractors, whether paid or volunteer, against any and all claims which may arise from any injury to said child while participating in this program. You have read and understand the above policy and agree to comply with its provisions.

• In the case of an emergency involving your child, you understand that every effort will be made to contact you. However, in the event that you cannot be reached to make arrangements for emergency medical attention at the time of illness or accident, you hereby authorize Artlab Maui staff to call 911 to provide urgent care for your child and further authorize your child to receive medical treatment from Artlab Maui selected medical provider as such medical provider deems necessary and appropriate.

Covid Waiver

• I acknowledge the contagious nature of COVID-19 and that using the Property and facilities located therein involves the risk of injury to me, my family and/or anyone else who may come in contact with me and/or my family. I accept and voluntarily assume all risks associated with my and my family’s use of the Property and its facilities, including, but not limited to, the risk that my family and I may be exposed to, come in contact with, and/or become infected with COVID-19, and that any such exposure or infection may result in personal injury, illness, permanent disability, and/or death. I agree to indemnify and hold ArtLab Maui, including but not limited to employees, volunteers, representatives and management staff (collectively, the “Released Parties”), harmless against any and all claims (whether known or unknown), demands, damages (including physical and economic), rights of action or causes of action (collectively, “Claims”), from any person or entity, whether or not caused by the sole or partial negligence of the Released Parties, which may be incurred or sustained by the Related Parties which result from or arise out of (either directly or indirectly) me or my family’s use of the Property and its facilities.

• Further, to the fullest extent permitted by law, I, for myself, my family, my heirs, executors and administrators, hereby fully and forever covenant not to sue the Released Parties, and forever release and discharge the Released Parties from any and all Claims, whether or not caused by the sole or partial negligence of the Released Parties, in connection with my or my family’s use of the Property and its facilities.

• I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Released Parties, and whether a COVID-19 infection occurs before, during, or after occupying the Property.

Responsibility of Parent/Guardian Policy

The following policy reflects our concern for your child’s physical welfare. Please read carefully. We cannot admit your child without your consent to this waiver.

• Artlab Maui is NOT responsible for children/students before or after the hours for which they are registered for class. Parents and children are welcome to enter Artlab Maui at the program’s stated start time. Tuition however, only covers teaching time and does not include supervision before or after class hours.

• Artlab Maui reserves the right to require parents or guardians to withdraw a child from class for disruptive behavior at any time
